The screen freezes on I-80, the app shows "Malfunction — code R," and the dispatcher keeps calling about the delivery window. This is where a driver either follows 49 CFR §395.34 step by step — or collects a violation that stays on the carrier's record for two years. Since April 1, 2026, CVSA's updated out-of-service criteria also cite ELD tampering separately under §395.8(e)(2). New to electronic logs? Start with our ELD compliance requirements guide.
No — that is a myth from Telegram trucking chats. Under §395.34(a)(1) the driver must note the malfunction and provide written or electronic notice to the carrier within 24 hours. A text or email with the date, time, and malfunction code satisfies this. The 60-minute figure comes from device monitoring windows in the ELD technical specification — a duty of the device, not the driver. The full driver sequence:
Letters = malfunctions, which trigger the paper-log duties above. Numbers = data diagnostic events, which are warnings: under §395.34(c) the driver follows the carrier's and ELD provider's recommendations and keeps using the device.
| Code | Type | Meaning | Driver action |
|---|---|---|---|
| P | Malfunction | Power compliance | Paper logs + 24-hr notice |
| E | Malfunction | Engine synchronization compliance | Paper logs + 24-hr notice |
| T | Malfunction | Timing compliance | Paper logs + 24-hr notice |
| L | Malfunction | Positioning compliance | Notice; manual location entries may suffice |
| R | Malfunction | Data recording compliance | Paper logs + 24-hr notice |
| S | Malfunction | Data transfer compliance | Notice; be ready to show display/printout |
| O | Malfunction | Other ELD-detected malfunction | Paper logs + 24-hr notice |
| 1–6 | Diagnostic | Power, engine sync, missing data, data transfer, unidentified driving, other | Follow carrier/provider recommendations |
Tip: code 5 (unidentified driving) usually means someone moved the truck without logging in — annotate those records promptly.
Under §395.34(d) the carrier must correct, repair, replace, or service the ELD within 8 days of discovering the condition or receiving the driver's notice — whichever occurs first — if the safety manager saw the dashboard alert before the driver's email, the clock already started. During those 8 days the driver operates legally on paper logs. Day 9 with no fix and no extension = a recordkeeping violation accruing $1,584 for every day it continues.
If the ELD provider cannot ship a replacement in time, the carrier — not the driver — may request more time under §395.34(e). The written request goes to the FMCSA Division Administrator for the state of the carrier's principal place of business, filed within 5 days after the driver's notice, and must include:
FMCSA responds in writing and may attach conditions. Miss the 5-day window and the 8-day limit stands. TruckerNavi drafts these letters the same day — in regulator-grade English, where many Russian-speaking dispatchers lose the deadline.
Under 49 CFR §395.22(h) every truck must already carry an ELD packet: the user's manual, a data-transfer instruction sheet, the malfunction instruction sheet, and blank graph-grid logs for at least 8 days. At the stop, hand the officer:
| Violation | Citation | Penalty (current schedule) |
|---|---|---|
| ELD not repaired within 8 days, no extension | §395.34(d) / recordkeeping | Up to $1,584 per day, capped at $15,846 |
| No records of duty status at roadside | §395.8(a) | Fine + possible 10-hour out-of-service |
| False log | §395.8(e)(1) | Up to $15,846 for knowing falsification |
| ELD tampering (new category) | §395.8(e)(2) | 10 consecutive hours OOS + penalties |
| Other HOS violations | 49 CFR §386 App. B | Up to $19,246 carrier / $4,812 driver |
Amounts are inflation-adjusted annually (49 CFR §386 Appendix B, per FMCSA). Each violation also feeds your HOS Compliance BASIC — the score that triggers audits, explained in our hours-of-service rules guide.

The current 24-hour period plus the previous 7 consecutive days on §395.8 graph-grids — unless still retrievable from the ELD (§395.34(a)(2)).
On paper logs while the carrier repairs or replaces the unit — within 8 days of discovery or driver notice, whichever comes first (§395.34(d)). Longer requires an FMCSA extension.
The carrier files with the FMCSA Division Administrator of its home state within 5 days of the driver's notice: USDOT number, contact person, ELD make/model/serial, malfunction date and location, good-faith repair efforts (§395.34(e)). FMCSA answers in writing.
Letter codes (P, E, T, L, R, S, O) are malfunctions — paper logs plus the 8-day rule. Numbers 1–6 are diagnostic warnings — follow carrier/provider recommendations (§395.34(c)) and keep using the ELD.
The malfunction instruction sheet, reconstructed paper logs for today plus 7 prior days, whatever the ELD can still display, and your dated notice to the carrier. Blank grids for 8 days must be onboard per §395.22(h).
