New authority ยท Insurance filing

What Insurance Activates MC Authority? BMC-91, BMC-91X, BOC-3 and the 20-Day Clock

The $300 fee opens a docket. The truck is a purchase. Neither one activates operating authority. One electronic filing from your insurer and one from your process agent do, and on October 23, 2026, 95% of all pending FMCSA authority applications were still waiting on the first of them.

Short answer. FMCSA grants operating authority when two documents are on record: (1) proof of public liability insurance on Form BMC-91 or BMC-91X, transmitted electronically by a registered filer at the insurance company, and (2) a BOC-3 designation of process agents, filed by the agent. A paid fee, a bound policy without the filing, a certificate of insurance, cargo coverage or physical damage coverage do not activate authority. For most for-hire carriers the liability filing must show at least $750,000 under 49 CFR 387.9.

Which coverage counts, which form carries it, and who is allowed to file

CoverageFMCSA formWho transmits itRequired to activate authority?
Public liability (bodily injury, property damage, environmental restoration)BMC-91 (one insurer carries the full amount) or BMC-91X (more than one insurer, or an amount below the full required level under a combined filing)Registered filer at the insurer, surety or financial institution. The carrier cannot upload it and does not receive a copy.Yes, for every motor carrier. Status reason on Motus until it arrives: "Financial Responsibility Filings".
Process agent designationBOC-3The designated process agent. Brokers and freight forwarders without vehicles may file their own; carriers may not.Yes. Second condition for grant and for keeping authority active.
Cargo (motor truck cargo)BMC-34 (or BMC-83 trust fund)InsurerOnly household goods carriers ($5,000 per vehicle, $10,000 per occurrence). General freight: not required by FMCSA; brokers and shippers require it by contract, usually $100,000.
Broker or freight forwarder financial securityBMC-84 surety bond or BMC-85 trust fund, $75,000Surety or financial institutionYes, for broker and freight forwarder authority instead of a liability filing. Carrier plus broker authority means two dockets, two clocks, two documents.
Physical damage, non-trucking liability, trailer interchange, general liability, occupational accident, workers' compensationNo FMCSA formNobody files them with FMCSANo. They may be required by a lender, a lessor or a broker, and they do nothing for the authority.

Minimum liability limits under 49 CFR 387.9

OperationMinimum limit on the filing
For-hire carrier, non-hazardous property, vehicles rated 10,001 lbs or more$750,000 (the schedule dates this figure to January 1, 1985)
For-hire carrier, non-hazardous property, every vehicle under 10,001 lbs$300,000
Oil, and hazardous materials and waste listed in 387.9 at the middle tier$1,000,000
Explosives (Division 1.1, 1.2, 1.3), poison gas, radioactive materials in highway route controlled quantities, and the most hazardous classes$5,000,000
Passenger carriers, 15 seats or fewer / 16 seats or more$1,500,000 / $5,000,000

The filing shows the limit the insurer certifies, not what the policy says on its declarations page. Most brokers and shippers require $1,000,000, so a new carrier usually buys $1,000,000 and the filer certifies that amount. A $100,000 cargo policy sits next to it for the brokers; it is not part of the authority.

The clock: 10, 20, 60 and roughly 90 days, counted from publication

  1. Day zero is the day FMCSA publishes the notice of your application in the FMCSA Register (the agency's own daily publication on motus.dot.gov, not the Federal Register). It is not the day you paid the $300 under 49 CFR 360.3T.
  2. 10 days for protests under 49 CFR 365.203T.
  3. 20 days for the liability filing and the BOC-3 under 49 CFR 365.109T(a)(5) and (6).
  4. 60 more days after FMCSA serves a decision for a file that missed the 20, then dismissal. FMCSA's FAQ rounds the whole span to approximately 90 days from the date the application was filed. The fee is not refunded; a new application means a new $300.

Why FMCSA says 20 to 25 business days and your file has sat for months. FMCSA's estimate applies to a complete application, with both filings already on record. By our count on October 23, 2026, 22,540 of 23,698 pending authority records (95.1%) carried no liability filing, and of those, 1,733 were brokers and freight forwarders who owe a bond instead, leaving 20,807 motor carriers waiting on one document from an insurer. An application without the filing is not in FMCSA's window at all. Current figures and sources: research and publications. Day-by-day sequence: MC authority activation timeline.

After activation: the filing has to stay on record

An authority stays active only while the liability filing and the BOC-3 stay on file. When a policy is canceled, the insurer sends FMCSA Form BMC-35 (BMC-36 for a bond). Under 49 CFR 387.313T the filing cannot be withdrawn earlier than 30 days after FMCSA receives the notice, and the policy itself requires 35 days' written notice under 387.7(b)(1). The record then shows a suspension for lapsed coverage. FMCSA's status history carried 3,381 suspension orders in June 2026 and 1,674 in July. The usual trigger is a missed premium finance installment on the first policy. A legal name change requires corrected filings and a corrected BOC-3 within 30 days.

Why a new carrier does not get quoted, and what fixes it

Admitted programs decline new ventures by rule, not by judgment: no loss history, a driver with under two years of CDL experience, a financed truck and an unknown garaging address. First-year carriers are written by non-standard and new-venture programs, and those programs quote only a complete submission. Five things an underwriter wants before the first number:

  1. Truck weight, type and VIN, with year, make, model, value and whether it is owned, financed or leased, plus the trailer.
  2. Garaging address and state. A home address is fine; a PO Box is not. The state decides which programs are available and whether the filing can be written at all.
  3. The owner's CDL, date of birth and years of experience, because in a one-truck company the owner is the driver.
  4. Loss runs or a signed statement that there is no prior commercial policy.
  5. A Motus profile that matches the submission: legal name, address, operation type, cargo and power units. Underwriters compare the two, and a mismatch stops the quote until the MCS-150 is corrected.

Sequence matters. The applications that activate fastest are the ones where the insurance producer and the process agent were lined up before the $300 was paid. Pay first and shop later, and the 20-day clock is running while you collect documents.

How TruckerNavi and SafeBridge get the two filings on record

Questions new carriers ask

What insurance activates MC authority?

Public liability (bodily injury and property damage) coverage proven to FMCSA on Form BMC-91 or BMC-91X. The form is transmitted by a registered filer at the insurer, never by the carrier. With a BOC-3 on record, it is the condition for FMCSA to grant authority.

How much liability insurance does FMCSA require?

$750,000 for for-hire carriers of non-hazardous property in vehicles of 10,001 pounds or more; $300,000 when every vehicle is lighter; $1,000,000 for oil and certain hazardous materials; $5,000,000 for the most hazardous classes (49 CFR 387.9). Most brokers require $1,000,000 by contract.

Does cargo insurance activate MC authority?

No. FMCSA requires a cargo filing (BMC-34) only from household goods carriers. For general freight, cargo coverage is a broker and shipper requirement, usually $100,000, and has no effect on the authority.

Can I file the BMC-91X myself?

No. Only a registered electronic filer at the insurer, surety or financial institution can transmit it, and FMCSA does not send the applicant a copy. Only the designated process agent can file a carrier's BOC-3.

Is a certificate of insurance enough?

No. A certificate is a summary for brokers and shippers. FMCSA recognizes only the electronic filing. A bound policy with a certificate in hand and no filing leaves the authority Pending with the reason Financial Responsibility Filings.

How long do I have to get the filing on record?

20 days from publication in the FMCSA Register under 49 CFR 365.109T for both the filing and the BOC-3, then a served decision with 60 more days before dismissal, roughly 90 days from filing by FMCSA's FAQ. The $300 per authority type is not refunded.

Why does FMCSA say 20 to 25 business days?

That estimate covers a complete application with both filings on record. On October 23, 2026, 95.1% of pending authority records had no liability filing, so they were waiting on an insurer, not on FMCSA.

What does "Pending, Financial Responsibility Filings" mean on Motus?

FMCSA has accepted the application and is waiting for the insurer's filing. The dashboard shows no deadline; the publication date and day 20 are in FMCSA's letter and in the daily FMCSA Register PDF.

Can I lose the authority after it is active?

Yes. A canceled policy produces a BMC-35; the filing drops 30 days after FMCSA receives it (49 CFR 387.313T) and the authority is suspended for lapsed coverage. 3,381 suspension orders in June 2026, 1,674 in July.

Why will no insurance company quote a new authority?

Admitted programs decline new ventures by rule. New-venture programs quote a complete submission: truck details, garaging address, the owner's CDL and experience, loss runs or a no-prior-insurance statement, and a Motus profile that matches.
